Terms of Service

Please read these terms carefully before using Knitlex.

1. Agreement to these terms

These terms govern your use of Knitlex, the mobile application published by Sylvanity B.V., a private limited company based in the Netherlands ("Sylvanity", "we", "us"). By installing or using the app you agree to these terms. If you do not agree to these terms, do not install or use the app.

2. About Knitlex

Knitlex is a TOEFL preparation app for adult learners. It combines two practice modules: an adaptive vocabulary trainer that uses a spaced-repetition scheduler, and a speaking module with section guides, response frameworks, tips, practice prompts, and academic phrases. Example sentences, speaking prompts, and academic phrases are personalised to keywords you provide and are generated by a third-party language model on our servers.

The app is currently distributed through the Apple App Store for iPhone and iPad. If it becomes available on additional platforms (for example, Google Play), these terms will continue to apply, supplemented by the relevant platform's standard end-user terms (see Section 16).

3. Who can use the app

Knitlex is intended for adults preparing for the TOEFL examination, typically university applicants and working professionals. It is not directed at children and is not listed in the App Store Kids Category. You confirm that you are at least 16 years of age (or the age of digital consent in your country, if higher) when you install or use the app.

The app contains no chat, no social features, no user-generated content visible to other users, no advertising, and no external links visible inside review sessions.

4. Account and sign-in

To use Knitlex you must sign in with one of two providers, both operated through Firebase Authentication:

  • Sign in with Apple (you can choose Hide My Email if you prefer not to share your real email address).
  • Sign in with Google.

You are responsible for keeping your provider account secure. If you lose access to your provider account, you may lose access to your Knitlex account and to your personalised content. Sylvanity does not offer a separate password reset; password and identity recovery are handled by Apple and Google.

You can delete your Knitlex account at any time from inside the app (Settings → Account → Delete account) or by emailing info@sylvanity.eu. The Privacy Policy describes what is deleted and what is retained.

5. Your right to use the app

Subject to these terms, Sylvanity grants you a personal, non-exclusive, non-transferable, revocable licence to install and use Knitlex on any compatible device that you own or control, for personal, non-commercial study purposes. This licence is also subject to the standard end-user terms of the application store from which you obtained the app. For Apple App Store downloads, this means Apple's Licensed Application End User License Agreement.

6. What you may not do

You may not:

  • Copy, modify, decompile, or reverse-engineer the app, except to the extent expressly permitted by applicable law (including, where applicable, EU Directive 2009/24/EC).
  • Redistribute, sell, sublicense, rent, or lease the app, any subscription entitlement, or any of the personalised content generated for your account.
  • Use the app, the content within it, or any output from it to construct a competing product, dataset, or training corpus, including by scraping the personalised content delivered to your device.
  • Submit prompts, keywords, or other inputs that are unlawful, defamatory, harassing, sexually explicit, or that contain other people's personal data.
  • Attempt to circumvent any rate limits, entitlement checks, or access controls in the app or in our backend.
  • Remove or alter any copyright, trademark, or other proprietary notices in the app.
  • Use the app in a way that violates applicable law or that harms the device, network, or other users.

7. Subscriptions, free trial, and lifetime purchase

Knitlex offers two ways to pay:

Knitlex Monthly (auto-renewing subscription)

  • Free introductory offer. First-time subscribers receive a 7-day free introductory period. The trial begins when you confirm the purchase in the App Store sheet, not when you first launch the app. Apple enforces eligibility (one trial per Apple ID per subscription group).
  • Price and term are shown to you on the in-app subscription screen and on the App Store product page before you commit. Local taxes and currency conversion are applied by Apple. Apple regional pricing applies, so the local-currency amount may vary.
  • Auto-renewal. The subscription renews automatically at the end of each billing period at the then-current price, unless you cancel at least 24 hours before the end of the current period. Renewal is processed by Apple.
  • How to cancel. Cancel at any time from your device's subscription-management screen: Settings → [your name] → Subscriptions on iPhone or iPad. Uninstalling the app does not cancel an active subscription.
  • What happens after cancellation. Access continues until the end of the current paid period; afterwards the app reverts to a non-entitled state in which the personalised content shown during your subscription remains visible on your device, but no new personalised content is generated and the keyword-change flow is disabled. Re-subscribing restores access.
  • Refunds are handled by Apple under its refund policy, not by Sylvanity. Sylvanity has no ability to issue refunds for App Store purchases.
  • Price changes. If we change the subscription price, Apple will notify you in accordance with App Store rules and you will need to confirm the new price before the next renewal can occur. If you do not confirm, the subscription will not renew.

Knitlex Lifetime (non-consumable in-app purchase)

  • A single, one-time payment grants permanent access to Knitlex on the Apple ID that purchased it, restorable to any device signed in with that Apple ID. There is no auto-renewal and no recurring charge.
  • The lifetime entitlement covers the app as it exists today and reasonable future updates within the same product line. It does not extend to separate apps or to optional add-on services that may be introduced later.
  • Refunds are handled by Apple under its refund policy.

EU consumer right of withdrawal

EU consumers normally have a 14-day right of withdrawal for digital purchases. By starting to use the entitled feature set during the free introductory period or immediately after purchasing, you expressly consent to the immediate performance of the digital service and acknowledge that you lose your right of withdrawal once performance begins, in accordance with Article 16(m) of Directive 2011/83/EU as amended.

8. Educational disclaimer and AI-generated content

Knitlex is a study aid. It is not a substitute for school instruction, professional teaching, or formal assessment, and we do not promise that using the app will result in any particular score or admission outcome. The "predicted score" shown in the app is a transparent heuristic that combines your placement tier, vocabulary mastery, and read-aloud confidence; it is presented as a range with an "estimate" label and is not affiliated with, endorsed by, or sponsored by ETS or any other testing body.

Example sentences, speaking prompts, sample answers, and academic phrases are generated by a third-party large language model (currently OpenAI's gpt-4o-mini). We screen outputs with an automated evaluator that checks for correct use of the target word, register, keyword integration, and length, and we regenerate failing outputs. Despite this, generated content can still contain factual errors, awkward phrasing, register mismatches, or culturally insensitive examples. You should treat generated content as practice material, not as authoritative source text.

References to "TOEFL" in the app and in this document describe the examination that Knitlex helps you prepare for; they are not a claim of partnership.

9. General disclaimer and limitation of liability

Knitlex is provided "as is" and "as available". To the fullest extent permitted by applicable law, Sylvanity makes no warranties, express or implied, regarding the app, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the app will be uninterrupted or error-free, that defects will be corrected, that personalised content will always be available on first request, or that the app will be compatible with any future operating-system version.

To the fullest extent permitted by Dutch law and applicable EU consumer-protection law, Sylvanity is not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profit, revenue, data, or examination outcome, arising from your use of (or inability to use) the app or from any reliance on its output, even if we have been advised of the possibility of such damages. Sylvanity's total cumulative liability arising from or related to the app, on any theory of liability, is limited to the greater of (a) the total amount you have paid to Apple for Knitlex in the twelve months preceding the event giving rise to the claim, or (b) fifty euros (€50).

Nothing in these terms limits or excludes any liability that cannot be limited or excluded under applicable law, including liability for gross negligence, intentional misconduct, death or personal injury caused by negligence, or your statutory rights as a consumer.

10. Privacy

Knitlex processes the limited data described in the Privacy Policy. Please read it before using the app. If you do not agree with the privacy practices described there, do not install or use the app.

11. Personalised content and keywords

You provide 3 to 5 free-text keywords describing your area of expertise during onboarding. These keywords are used to flavour the example sentences, speaking prompts, and academic phrases generated for you. You can change your keywords inside the app, subject to a 7-day rate limit; the rate limit exists to keep generation costs proportionate to the value you receive.

You are responsible for the keywords you submit. Do not submit other people's personal data, defamatory content, or content that is unlawful or offensive. We reserve the right to filter or reject keywords that violate these rules and, in egregious cases, to suspend or delete the account.

The personalised content generated for your account is licensed to you under the same licence described in Section 5; it is not assigned to you. You may review the content inside the app and copy short excerpts for personal study notes. You may not republish, sell, or use the content as training data for another model.

12. Notifications, Live Activity, and read-aloud

Knitlex sends only local notifications scheduled on your device (a daily review reminder and a one-shot exam-7-days reminder). The app does not register for Apple Push Notification service. You can turn the daily reminder on or off in Settings; you can turn the optional Lock-Screen Live Activity on or off independently in Settings.

The read-aloud feature is self-rated. The app does not record audio at any point and does not access the microphone. By using the read-aloud feature you agree to be honest in your self-rating; the app uses your ratings to compute a fluency trend, which is shown to you only and is never transmitted off the device.

13. Changes to the app and to these terms

Sylvanity may update the app from time to time and may update these terms when the app's behaviour, the subscription model, or applicable law changes. Updated terms will be posted on this page with a new "Last updated" date. Material changes will also be noted in the App Store release notes for the relevant version. Continued use of the app after a change takes effect means you accept the updated terms. If you do not accept the updated terms, you should cancel any active subscription and uninstall the app.

14. Termination

You may stop using the app at any time by uninstalling it; if you have an active subscription you should also cancel it from your device's subscription-management screen as described in Section 7. Sylvanity may discontinue the app, or any version of it, at any time. If the app is removed from the App Store or is no longer maintained, an existing installed copy will continue to work for as long as the device's operating system supports it; an active subscription will continue to be billed by Apple until you cancel it.

We may suspend or terminate your account if you breach these terms in a way that materially harms other users, the integrity of the service, or our legitimate interests. Where it is reasonable to do so, we will give you advance notice and an opportunity to cure the breach.

15. Governing law and jurisdiction

These terms are governed by the laws of the Netherlands, without regard to conflict-of-law principles. Any dispute arising from these terms or your use of the app will be brought before the competent courts of the Netherlands. This is without prejudice to any mandatory rights you have as a consumer under the laws of your country of residence, including the right to bring proceedings in the courts of that country.

16. Application-store terms

The end-user terms of the application store from which you obtained the app apply in addition to these terms. If there is a conflict between these terms and the application-store terms, the application-store terms prevail to the extent of the conflict and only with respect to the matters they cover (for example, the refund policy and the in-app purchase mechanics).

For users who downloaded the app from the Apple App Store, you acknowledge that these terms are between you and Sylvanity, not Apple. Apple is not responsible for the app, its content, or any failure to conform to any warranty. Apple is, however, a third-party beneficiary of these terms and may enforce them against you.

17. Severability and entire agreement

If any provision of these terms is held to be invalid or unenforceable, the remaining provisions remain in full effect. These terms, together with the Privacy Policy and the applicable application-store terms, are the entire agreement between you and Sylvanity regarding the app, and replace any prior agreements on the same subject.
